FIRST & SECOND QUARTER
Introduction
The first and second quarter of 2022 proved to be a busy one as the legislature continues to look forward from the pandemic. The Chamber of Commerce Southern New Jersey (CCSNJ) is grateful to be back speaking with legislators in the halls of Trenton on behalf of our members. We welcome your feedback, comments and suggestions on how we can better serve you and your thoughts on the issues the CCSNJ has weighed in on during the first and second quarter of 2022.
Fiscal Year 2023 State Budget
On March 8, the Governor proposed a $48.9 billion budget, which included a proposed surplus of $4.2 billion. In May, the administration updated their revenue forecasts, adding more than $3 billion to the bottom line. The CCSNJ testified at the Senate and Assembly public hearings, requesting that the legislature add more assistance for the business community in addition to the $50 million allocated to the Main Street Recovery Fund. The CCSNJ also urged the legislature to include an allocation of American Rescue Plan Act funds to fully or partially replenish UI funds to avoid a tax increase for employers in the final budget.Â

On June 30, Governor Murphy signed the FY2023 State Budget. Although the final $50.6 billion FY2023 budget is the largest in state history with no new taxes, it included minimal assistance to the state’s business community.
Businesses were not included in the signature property tax relief program known as ANCHOR. The property tax relief program replaces the previous Homestead Benefit program and will provide homeowners with a household income of under $150,000 with a $1,500 property tax benefit each year; homeowners with a household income between $150,000 and $250,000 will receive a $1,000 property tax benefit each year; and renters with incomes up to $150,000 will receive $450.Â
The budget also contained a $6.8 billion contribution the public worker pension fund, and a $6.3 billion surplus, which is the largest in modern state history.
CCSNJ President and CEO Christina Renna released the following statement on the signing of the State Budget:Â
"Today, Governor Murphy signed the largest budget in state history - $50.6 billion – in which a mere $50 million was allocated for New Jersey’s small businesses community. This is simply unacceptable as businesses continue to recover from the pandemic. The Chamber of Commerce Southern New Jersey (CCSNJ) is strongly disappointed that state government did not prioritize the plight of struggling small businesses, many of which are women and minority-owned, given the strong financial position New Jersey is currently in.
While the CCSNJ was pleased to see that this budget did not include new taxes or fees, it also does not offer new, long-term revenue sources that New Jersey can rely on in the future. And, although pleased to see fiscally responsible actions such as a full pension payment, the CCSNJ remains concerned that maintaining this level of long-term growth in spending will be impossible without future tax increases that will undoubtedly fall on the backs of the state’s business community. The final FY2023 budget, combined with the Governor’s and Legislature’s lack of action to defer Unemployment Insurance (UI) tax increases on businesses, ends an incredibly disappointing budget season where New Jersey-based businesses were nothing short of ignored."

Priorities:
Unemployment Insurance Tax Relief for Small Businesses
In October of last year, employers were faced with a $252 million increase in unemployment insurance (UI) taxes due to historic unemployment levels caused by the pandemic. Businesses will be burdened with an additional $1 billion in UI tax increases over the next two years unless funds are allocated to offset these increases. The CCSNJ strongly advocated for A-3683/A-2152/S-733/S-2378 (Freiman/Greenwald/Chaparro/Dancer/Madden/ Singleton/Gopal/Zwicker) which would provide tax credits to small businesses to offset an increase in State Unemployment Insurance contributions.
On June 29, the New Jersey Senate and General Assembly held their final voting sessions before the Legislature’s summer recess. The bill was removed from the Senate agenda and did not move to the Governor's desk for action.Â
CCSNJ President and CEO Christina Renna released the following statement expressing disappointment that the legislation was not acted upon:Â
"Today, state government did not act on a bill the CCSNJ has strongly advocated for, which would offset future unemployment insurance (UI) tax increases that collectively totals an approximate $1 billion tax hike on businesses over the next two years. Businesses did their part during the height of the pandemic, shutting their doors to adhere to the state’s mandated public health guidelines. As a result, employers had to lay off workers and the state faced historic unemployment levels that heavily drew down the New Jersey’s UI fund. This draw down will now lead to unfair tax increases on businesses that state government had the power to stop, but instead chose to turn a blind eye to. The continued plight of small businesses, especially those that are women and minority-owned, remains very real. It is well-known that the state is flush with cash due to federal recovery money. The CCSNJ is disappointed that Governor Murphy and others did not find use of these funds as appropriate to use to avoid a tax increase on New Jersey’s small businesses."

Teen Workers
The CCSNJ proudly supported A-4222/S-2796 (Freiman/Egan/Calabrese/Gopal) which expanded working hours for minors as well as updated process for obtaining working papers for minors. Shore businesses have found it difficult to find employees and were often unable to hire an eager and available teen workforce due to outdated restrictions and procedures for minors to participate in the labor force. The bill will allow the shore businesses to be fully staffed and offer patrons the full experience of the Jersey shore.
The bill passed both houses on June 29, 2022 and was signed into law by the Governor on July 5, 2022.Â

Childcare Package
The CCSNJ was proud to support a package of bills aimed at tackling the childcare issue in the state and assist working parents return to the labor force.
